According to the complaint, filed in 2018 on behalf of Sam Kuhn and Lynn Buchanan by the Centre for Research Action on Race Relations (CRARR), in failing to provide a psycho-educational assessment of daughter Simone and by telling the low-income couple to pay for the evaluation from their own pockets, the EMSB denied the child an essential service for her education and thereby discriminated against her.
